Definitions

Goods incorporating digital elements: Movable tangible property that incorporates digital content or a digital service, or is interconnected with them in such a way that the goods would not be able to perform their functions without the digital content or digital service.
Digital content: Data which is produced and supplied in digital form.
Parties: The Service Provider and the Buyer collectively.
Consumer: A natural person acting outside the scope of their profession, independent occupation or business activity.
Consumer contract: A contract in which one of the parties qualifies as a consumer.
Functionality: The ability of goods incorporating digital elements, digital content or a digital service to perform the functions necessary for their intended purpose.
Manufacturer: The producer of the Goods, or, in the case of imported goods, the importer bringing them into the territory of the European Union, as well as any person who presents themselves as the manufacturer by indicating their name, trademark or other distinguishing mark on the packaging of the goods.
Interoperability: The ability of goods incorporating digital elements, digital content or a digital service to operate with hardware or software different from that with which goods of the same type are normally used.
Compatibility: The ability of goods incorporating digital elements, digital content or a digital service to operate, without conversion, with hardware and software with which goods of the same type are normally used.
Website: The website operated by the Service Provider, which serves as the platform for concluding contracts.
Durable medium: Any instrument which enables the addressee to store information addressed personally to them in a way accessible for future reference for a period of time adequate for the purposes of the information and which allows the unchanged reproduction of the information stored.
Means of communication between absent parties: Any means which enables the parties to conclude a contract without their simultaneous physical presence. Such means may include, for example, the internet, telephone, fax, printed forms or advertisements containing an order form.
Distance contract: A consumer contract concluded within an organized distance sales system using exclusively means of distance communication.
Business: A natural or legal person acting within the scope of their professional or business activity.
Buyer / You: The person who makes an offer to purchase through the Website and thereby enters into a contract with the Service Provider.

Warranty: In the case of contracts concluded between a consumer and a business, warranty shall be understood as follows:

  1. Voluntary warranty: An obligation voluntarily undertaken by the business, beyond or in the absence of a statutory obligation, to properly perform the contract.
  2. Mandatory warranty: A warranty based on legislation that is binding on the business.

Purchase price: The consideration payable for the Goods and for the provision of digital content.

The provisions of Hungarian law shall apply to the Contract, in particular the following legislation:

  • Act CLV of 1997 on Consumer Protection
  • Act CVIII of 2001 on Certain Issues Concerning Electronic Commerce Services and Information Society Services
  • Act V of 2013 on the Civil Code
  • Government Decree 151/2003 (IX.22.) on Mandatory Warranty for Certain Durable Consumer Goods

Scope and Acceptance of the General Terms and Conditions (GTC)
These General Terms and Conditions (hereinafter: GTC) determine the content of the contractual relationship established through the Website, in addition to the applicable mandatory statutory provisions. The GTC contain the rights and obligations of the Buyer and the Service Provider, the conditions for concluding the contract, performance deadlines, payment and delivery conditions, liability provisions, and the procedure for exercising the right of withdrawal.
Technical information necessary for using the Website, insofar as it is not contained in these GTC, is provided through other information available on the Website.
Before finalizing an order, the Buyer is required to become familiar with and accept the provisions of these GTC.

Language and Form of the Contract
The language of contracts falling within the scope of these GTC is Hungarian.
These contracts are concluded electronically, do not qualify as contracts made in writing, and are not filed by the Service Provider.

Complaint Handling and Legal Remedies
If you have an individual legal or interest-related grievance concerning the purchased goods, the Service Provider, or the activities of a person acting on behalf of the Service Provider, you may submit your complaint through one of the following contact details:

It is important to note that separate legislation applies to the assessment of warranty and guarantee claims; these are not handled under the rules of the Fgytv. (Consumer Protection Act).
A consumer protection complaint – which does not qualify as a warranty or guarantee claim – may be submitted verbally or in writing. We will investigate verbal complaints immediately, and if an immediate solution is not possible, we will prepare a report thereof, a copy of which will be provided to the consumer.
The business is required to examine verbal complaints immediately and remedy them as necessary. The business is required to examine verbal complaints without delay and, where possible, remedy them immediately. If the consumer disagrees with the manner in which the complaint is handled, or if immediate investigation is not possible, the business is required to prepare a report of the complaint and its position.


One copy of the report:

  • in the case of a verbal complaint made in person, must be handed over to the consumer on the spot,
  • in the case of a complaint made by telephone or another electronic communications service, must be sent no later than 30 days later, together with a substantive response, in accordance with the rules applicable to written complaints. The report prepared on the complaint must contain the following:
  1. the consumer's name and address,
  2. the place, date and manner in which the complaint was submitted,
  3. a detailed description of the consumer's complaint, and a list of the documents, records and other evidence presented by the consumer,
  4. the business's statement regarding its position on the consumer's complaint, if immediate investigation of the complaint is possible,
  5. the signature of the person preparing the report and – except in the case of a verbal complaint made by telephone or another electronic communications service – the signature of the consumer,
  6. the place and date of preparation of the report,
  7. in the case of a verbal complaint made by telephone or another electronic communications service, the unique identification number of the complaint.

Written complaints must be answered by the business in writing, in a verifiable manner, within 30 days of receipt, unless otherwise provided by EU legislation, and the business must arrange for the response to be forwarded. If the complaint is rejected, the business must send its position to the consumer in writing, together with reasons. In this case, information must also be provided regarding which authority or conciliation body the consumer may contact, depending on the nature of the complaint. The information must include the name, address, telephone number, electronic contact details and mailing address of the competent organization. The Service Provider has not made a general submission statement.

Legal remedies – if complaint handling does not lead to a result

Consumer Protection Procedure
The consumer is entitled to submit a complaint to the consumer protection authority competent according to their place of residence if they believe that their rights have been violated. Following the complaint, the authority decides whether to initiate proceedings. Consumer protection authority tasks at first instance are performed by the metropolitan and county government offices, whose contact details are available on the following page:

Court Proceedings
If no satisfactory agreement is reached in a consumer dispute, the customer is entitled to enforce their claim through court proceedings. Court proceedings are governed by Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.

Conciliation Board Proceedings
If a consumer complaint is rejected, you have the opportunity to contact the Conciliation Board competent according to your place of residence or stay, or a Conciliation Board chosen by you. A prerequisite for initiating the proceedings is that the consumer must first attempt to resolve the disputed matter directly with the business.

The Conciliation Board shall conduct the proceedings by means of an online hearing if the consumer does not request a personal hearing, using an electronic device that ensures the transmission of sound and images.
Our business is obliged to cooperate during the proceedings, including submitting a written response within the specified deadline upon request by the board and ensuring that a representative authorized to conclude a settlement is present online during the proceedings.
If the consumer requests a personal hearing, the representative of the business is required to be present at the hearing at least online.

Conciliation Board Proceedings for Persons Not Qualifying as Consumers
Under consumer protection regulations, certain organizations defined by law – such as civil organizations, ecclesiastical legal entities, condominium associations and housing cooperatives – are also entitled to make use of Conciliation Board proceedings even if their activities do not qualify as consumer activities. This is subject to the condition that the organization orders, uses or obtains the goods for purposes unrelated to its business or independent professional activity. The Conciliation Board is entitled to verify and assess whether consumer status exists. The general rules governing Conciliation Board proceedings shall apply to such proceedings.

Partial Invalidity, Code of Conduct
If any provision of these GTC violates applicable law or is invalid, this shall not affect the validity of the remaining provisions. Such provisions shall be replaced by the applicable statutory provisions.
The Service Provider does not have a code of conduct within the meaning of the legislation prohibiting unfair commercial practices against consumers.
